Terms of Use

Please read these Terms of Use carefully before using our Service.

Words that begin with a capital letter have the meanings set out below. The definitions apply whether used in the singular or the plural.

• Application - The mobile or desktop software made available by the Entity and installed on any compatible device. In this document, it refers to the Tiger Lily Technologies app.
   
• Application Store - The digital distribution services operated by Apple Inc. (Apple App Store) and Google LLC (Google Play Store) where the Application may be obtained.
   
• Affiliate - Any entity that controls, is controlled by, or is under common control with a party. For this purpose, control means direct or indirect ownership of 50 percent or more of the voting interests or other securities entitled to elect directors or similar management authority.
   
• Entity - Tiger Lily Technologies, headquartered in Tel Aviv, Israel. Also referred to as Tiger Lily Technologies, we, us, or our.
   
• Device - Any device that can access the Service, such as a computer, smartphone, or tablet.
   
• Service - The Application and any related features provided by the Entity.
   
• Terms - These Terms of Use, which form the complete agreement between you and the Entity regarding your use of the Service. These Terms were initially prepared with automated drafting assistance.
   
• Third-party Social Media Service - Any third-party services or content that may be displayed in, included with, or made available through the Service, including data, information, products, or services.
   
• You - The individual accessing or using the Service, or the company or other legal entity on whose behalf that individual accesses or uses the Service.
   

• These Terms govern your use of the Service and constitute a binding agreement between you and the Entity. They describe the rights and obligations of all users of the Service.
   
• Your access to and use of the Service are conditioned on your full acceptance of and compliance with these Terms. These obligations apply to all visitors and users.
   
• By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any provision, you must not use the Service.
   
• You confirm that you are at least 18 years old. Persons under 18 are not permitted to use the Service.
   
• Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, disclose, and protect personal information and describes your privacy rights. Review the Privacy Policy carefully before using the Service.
   

• The Service may contain links to websites or services that are not owned or controlled by the Entity.
   
• The Entity does not control and is not responsible for the content, privacy policies, or practices of any third-party websites or services. You agree that the Entity will not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any such content, goods, or services available on or through any third-party websites or services.
   
• We encourage you to read the terms and conditions and privacy policies of every third-party site or service you visit.
   

• We may suspend or terminate your access to the Service at any time, immediately and without prior notice, for any reason, including if you breach these Terms.
   
• Upon termination, your right to use the Service ceases immediately.
   

• To the fullest extent permitted by law, the total aggregate liability of the Entity and its suppliers for any and all claims arising out of or related to these Terms or the Service will not exceed the greater of the amount you actually paid through the Service, if any, or 100 USD where no such purchase was made.
   
• To the maximum extent permitted by law, in no event will the Entity or its suppliers be liable for any special, incidental, indirect, or consequential damages of any kind. These include, without limitation, lost profits, loss of data or other information, business interruption, personal injury, loss of privacy, or any inability to use the Service or to use third-party software or hardware used with the Service, even if advised of the possibility of such damages and even if a remedy fails of its essential purpose.
   
• Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages. In those jurisdictions, liability will be limited to the greatest extent permitted by applicable law.
   

• The Service is provided on an “as is” and “as available” basis, with all faults and defects. To the maximum extent permitted by applicable law, the Entity, on its own behalf and on behalf of its Affiliates and their respective licensors and service providers, disclaims all warranties, whether express, implied, statutory, or otherwise. This includes implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing, usage, or trade.
   
• Without limiting the foregoing, the Entity makes no representation or warranty that: (i) the Service or content provided through it will meet your requirements or expectations; (ii) the Service will be compatible with any particular software, applications, systems, or services; (iii) the Service will be uninterrupted, timely, secure, or error free; (iv) information or content provided through the Service will be accurate, reliable, or up to date; or (v) the Service, its servers, content, or emails sent from or on behalf of the Entity will be free of viruses, scripts, trojan horses, worms, malware, time bombs, or other harmful components.
   
• Some jurisdictions do not allow certain exclusions of warranties or limitations on consumer rights, so portions of this section may not apply to you. Where exclusions or limitations are not permitted, they will apply to the maximum extent enforceable under applicable law.
   

• These Terms and your use of the Service are governed by the laws of the Country, without regard to its conflict of laws principles. Your use of the Application may also be subject to other local, state, national, or international laws.
   
• If you have a concern or dispute regarding the Service, you agree to first contact the Entity and attempt to resolve the matter informally.
   

• If you are a consumer who resides in the European Union, you will benefit from any mandatory provisions of the law of the country in which you are resident.
   

• You represent and warrant that: (i) you are not located in a country subject to a United States government embargo or designated by the U.S. government as a terrorist supporting country, and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
   

• If any provision of these Terms is held to be invalid or unenforceable, that provision will be deemed modified to the minimum extent necessary to accomplish its objectives to the fullest extent permitted by law. The remaining provisions will remain in full force and effect.
   

• A failure to exercise, or delay in exercising, any right or requirement under these Terms does not operate as a waiver. A waiver of a breach does not constitute a waiver of any subsequent breach.
   

• If we provide a translation of these Terms, the English version will control in the event of any conflict or dispute.
   

• We may update or replace these Terms at our discretion. If a change is material, we will make reasonable efforts to provide at least 30 days’ notice before the new terms take effect. What constitutes a material change will be determined by us.
   
• Your continued access to or use of the Service after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
